Terms of use – My Will

These terms of use apply to the app My Will (Mein Testament) and are also shown in the app.

This translation is provided for information only. The German version of these terms of use is authoritative.

1. Subject matter

My Will is a document generator for wills under German law. The app is based exclusively on German law; it does not take foreign law into account. The app serves only to record information and, where applicable, to pass it on to a lawyer or notary. Not every circumstance that could conceivably be relevant is asked about or taken into account. In the recommended legal advice, such circumstances may lead to contrary results. The app only gives general notes and attempts, according to fixed rules, to determine from your details a possible statutory succession and any compulsory shares (Pflichtteil). Using fixed templates, the app produces a sample will text. It does not examine your individual case.

The app does not provide legal services and does not replace advice from a lawyer or notary. No lawyer–client or advisory relationship is created. You are strongly advised to seek legal advice.

In general, but especially with larger assets, real estate, businesses, assets or residence abroad, a child with a disability or receiving social benefits, blended families and earlier joint wills or inheritance contracts, you should consult a notary or a specialist lawyer for inheritance law.

4. Form of the will

A will is only valid if you write it entirely by hand and sign it (§ 2247 BGB, German Civil Code) or have it drawn up by a notary. State the date and place; if they are missing, doubts about its validity may arise (§ 2247 Abs. 2 and 5 BGB). The app’s texts and PDF files are at most templates for copying out by hand.

5. Results without guarantee

Calculations and notes are based solely on your details and simplify special cases. Notes are deliberately cautious (“may”, “could”) and describe possible consequences, not a certain outcome. Check everything before use, or have it checked. The results are provided without any guarantee of accuracy, completeness or currency.

6. Tax notes

Information on German inheritance tax – tax-free allowances, tax classes, exemptions and the rough estimate – is general in nature and based on the law at the time the app was created and on your estimates. It is not tax advice, is provided without guarantee and is subject to review by a tax adviser or another authorised person.

7. Liability

Liability is unlimited for intent and gross negligence, for damage resulting from injury to life, body or health, and under the German Product Liability Act (Produkthaftungsgesetz). In the event of a breach of an essential contractual obligation through slight negligence – an obligation whose fulfilment is a prerequisite for the proper use of the app and on whose observance you may regularly rely – liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded.

8. Full version and Clients

The basic version is free. The one-time in-app purchase “Full version” unlocks the will text with explanations and the PDF files (copy template, summary for a notary or lawyer, funeral instructions, letter to my family). The “Client management” upgrade is a separate purchase, not part of the full version and only available after it; it allows you to create separate records. Purchases, restoring and refunds are governed by Apple’s terms; there is no subscription.

9. Data and deletion

All details stay on your device, including those on health, debts and family. The app does not transmit any data and uses no cloud services. Data only leaves the device if you share or send files; you are responsible for the transmission channel yourself. With “Delete all data – reset app” in the “Will” tab you can irrevocably delete all details and files at any time; purchased unlocks are retained.

10. References to lawyers

References to lawyers are marked as advertisements. A lawyer–client relationship only arises once the lawyer expressly accepts the instruction.
